Protection of a farming enterprise’s interests in commercial court proceedings concerning the recovery of funds.

Nataliia Hniezdilova, Attorney and Senior Lawyer at Formative Partners, successfully protected the interests of a farming enterprise in a monetary recovery case before the Commercial Court of Cherkasy Oblast.

A supply agreement had been concluded between the farming enterprise and a supplier of mineral fertilizers on the basis of advance payment.

The farming enterprise made the payment for the goods; however, the supplier fulfilled its obligations only partially. The Commercial Court of Cherkasy Oblast agreed with all the arguments presented by the attorney and fully satisfied the claim, ordering the debtor to pay the principal debt, penalties, 3% annual interest, and inflation losses.

The decision of the first-instance court was upheld by the Northern Commercial Court of Appeal.
